Who is covered by the Canadian 23andMe settlement?

The Canadian settlement covers individuals who were 23andMe customers at any time between May 1, 2023 and October 1, 2023, resided in Canada during that cyber security incident period, received notice from 23andMe that their personal information was compromised, and did not opt out of the Canadian Data Breach Settlement.

The settlement website identifies the British Columbia Supreme Court files as J.R. v. 23andMe Holding Co. et al., BCSC court file no. S-237147, and J.R. and M.M. v. 23andMe Holding Co. et al., BCSC court file no. S-246520.

How much can eligible Canadians claim?

The Canadian settlement website says the gross settlement amount is US$3.25 million, approximately C$4.49 million. Eligible Canadian claimants may receive two types of compensation.

  • Extraordinary claims: up to CA$2,500 for documented, unreimbursed, out-of-pocket expenses incurred between October 1, 2023 and March 31, 2024 as a direct result of the cyber security incident.
  • Ordinary claims: a pro-rated share of available settlement funds. The settlement website says eligible Canadian claimants who complete and submit a valid Canadian claim form will be automatically considered, without needing to provide further information or documentation.

The final ordinary-claim amount depends on the available settlement funds and the number of valid claims. All payments will be issued in Canadian currency.

What expenses can count for an extraordinary claim?

The settlement website lists examples of extraordinary expenses: costs associated with buying a physical security or monitoring system, costs associated with seeking professional mental health counselling or treatment, and other documented expenses incurred as a direct result of the cyber security incident.

For an extraordinary claim, gather proof before submitting. That may include receipts, invoices, statements, correspondence, or other documentation showing the cost, date, and connection to the incident.

Why the deadline matters

The Canadian settlement site says the claims period began on March 27, 2026 and will end on June 25, 2026 at 11:59 PM Pacific Time.
